011 | [Situation] About 2 miles E.S.E. [East South East] from Little Vantage. A well constructed farm house with offices and a farm of land attached occupd [occupied] by Mr Aitken & the property of Sir William Foulis, Bart [Baronet]. It was a matter of dispute for sometime to ascertain which parish this farm belonged to in the title deeds which extends backwards upwards of two centurys [centuries] it is sometimes described as lying in one parish and sometimes in another and occasionally no parish is mentioned. The Law Agent of the Heritors of Kirknewton instituted proceedings in the Court of Session against the proprietor of this farm for to establish that the farm belonged to Kirknewton The decision of the court was declared in 1830 which was that Listonshiels was not part of Kirknewton. A similar Law Suit was instituted by the Common agent for Kirkliston and in 1840 the case was decded, the judge Lord Cumming have pronounce an interlocutor finding the lands of Listonshiels subject to Allocation in the parish of Kirkliston This interlocutor was acquiesced in and has long become final. |
