1. Agreement

These pages and any page it links to explains ScotlandsPeople.gov.uk terms of use. You must agree to these to use ScotlandsPeople.gov.uk. By accessing, browsing or using the website you indicate that you accept these terms and conditions of use which is inclusive of our Purchasing Terms and Conditions (to access our historical records and material), Privacy (including Cookies) Policy and Copyright Policy.

If you do not agree with any of these terms and conditions of use you must not use the website.

These terms and conditions of use apply to all visitors and users registering on the website ("User"). 

We can update and/or revise the terms and conditions at any time without notice. Please check them regularly for changes as they are binding on you.

You will agree to any changes if you continue to use ScotlandsPeople.gov.uk after the terms and conditions have been updated and/or revised. If you do not accept these updated terms and conditions you should discontinue use of the website.

2. Who we are

ScotlandsPeople.gov.uk is a Government website owned, operated and managed by National Records of Scotland (NRS), (a non-ministerial Department of the Scottish Government) whose office is at New Register House, 3 West Register Street, Edinburgh, EH1 3YT.

3. Website purpose

ScotlandsPeople.gov.uk is an online service intended to provide Users with access to electronic indexes and digitised images of records to support their research and to provide access to other National Records of Scotland (NRS) services.

4. Using ScotlandsPeople.gov.uk

You can only use this website for personal or professional family history research (as a self-employed genealogist), private study or education, historical or statistical research and only in accordance with these terms and conditions.

You agree to use ScotlandsPeople.gov.uk only for lawful purposes and to comply with all applicable laws and regulations. You must also use it in a way that does not:

(i) infringe the rights of, or restrict or inhibit the use and enjoyment of this site by anyone else;
(ii) damage our name or reputation.

(a) What you are permitted to do
You acknowledge and agree that the Content contained within the website is either in Crown copyright, rights related to or affording protection similar to copyright, owned by National Records of Scotland or licensed to us and is made available for your personal or professional family history research (as a self-employed genealogist), private study or educational use or for historical or statistical research only and that you may (including where it is necessary to make a purchase) download such Content onto your personal electronic devices for such purposes. Any other use of the material and content on the Website is strictly prohibited.

(b) What you are not permitted to do
You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, distribute, commercially exploit or create derivative works of the Website or Content.

When using ScotlandsPeople.gov.uk you must not:

(i) use robots, spiders, crawlers, scraping or other data extraction, data mining or automatic access tools to download Content from the website;
(ii) introduce viruses, trojans, worms, logic bombs or any other material that's malicious or technologically harmful;
(iii) try to gain unauthorised access to ScotlandsPeople.gov.uk, the server on which it's stored or any server, computer or database connected to it;
(iv) use the website to transmit any unsolicited or unauthorised advertising or promotional materials (spam);
(v) reproduce, copy, distribute, re-sell or publically display any part of the website which contravenes these terms and conditions of use;
(vi) use the website for business or commercial purposes (other than professional family history research as a self-employed genealogist);
(vii) post or transmit any unlawful, threatening, defamatory, obscene, inflammatory, pornographic or illegal materials;
(viii) do anything that shall infringe any patent, trade mark, registered design, copyright or other right in the nature of intellectual property of any third party;
(ix) attack ScotlandsPeople.gov.uk in any way. This includes denial of service attacks.

We will report attacks or attempts to gain unauthorised access to ScotlandsPeople.gov.uk to the relevant law enforcement authorities and then co-operate with those authorities by sharing information about you with them. In the event of such a breach, your right to use our Website will cease immediately.

Where you are found to be in breach of any of the terms and conditions of this Agreement your User account may be terminated and you may be required to destroy, or return to us, any copies of the Content you have made which is in breach of this Agreement.

5. Commercial use

6. Intellectual property rights

The data, text, images, information and any database made up of any of these which features on or is accessible by Users of the ScotlandsPeople.gov.uk Website is either subject to Crown copyright, rights related to or affording protection similar to copyright, owned by National Records of Scotland or licensed to us and may only be used in accordance with this Agreement. This includes the design, structure and code employed in the Website.

You acknowledge and agree that all copyright, trade marks and other intellectual property rights in all content or material or supplied as part of the Website shall remain at all times vested in us and/or our licensors and you are permitted to use this material only in accordance with this Agreement.

It shall be a condition of this Agreement that you will do nothing when using ScotlandsPeople.gov.uk that shall infringe any patent, trade mark, registered design, copyright or other right in the nature of intellectual property of any third party.

We reserve the right to terminate forthwith, or refuse to permit, the use of the Website or any of the products or services provided through the Website by any User at any time and at our absolute discretion.

7. Content disclaimer

We seek to ensure that the information on the website is up to date and accurate and we will use reasonable endeavours to verify the reliability, accuracy, timeliness, usefulness or completeness of any information we place on ScotlandsPeople.gov.uk. However, ScotlandsPeople.gov.uk is provided on an "as is" basis and an "as available" basis, without any representation or endorsement made and without warranty of any kind whether express or implied. We shall not be liable in any way for any damage, loss, costs or expenses arising directly or indirectly from the downloading of any of the content from the website, or its reliance on or use of any of the contents for any purpose.

We do not warrant or represent that the functions contained in the materials or content available on the Website will meet your requirements or will be uninterrupted, timely or error free, that defects will be corrected, or that the Website or the servers that make them available are free of viruses or bugs or represent the full functionality, accuracy or reliability of the content or materials. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

We update ScotlandsPeople.gov.uk all the time. We may from time to time permanently or temporarily modify or withdraw the website, or alter any aspect of the website, or any of the services, provided through the website without notice to Users.

No data transmission over the internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information which you transmit to us is transmitted at your own risk.

To provide increased value to our Users, we may provide links to other websites or resources for you to access at your sole discretion. We cannot be held responsible for the contents of any pages referenced by a hypertext link to the websites and services of third parties. Such links may be provided for Users' convenience only, and their provision does not constitute an authorisation by us for the Website Users to access such third party websites. We shall not be liable for any damages, loss, costs or expenses arising through such third party websites.

8. Accessing ScotlandsPeople.gov.uk

If you choose to register on the Website you will be required to create a password as part of our security procedures. Your password must be treated as confidential. You must not disclose it to any third party.

You are responsible for ensuring that all of your personal information is correct and up-to-date. This can be managed by you via the 'My account' section of this Website.

You agree to accept responsibility for all usage and activities that occur under your account and you should let us know immediately if you believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. We shall not be liable to any person for any loss or damage that may arise as a result of your failure to keep your password and account protected.

You may delete your account at any time which will delete all of your personal information including the ability to access the history of your activity including, for example, viewed images and saved searches. Once your account is deleted, there is no option for recovery.

You may delete any of your saved images, or your timeline, at any time. However, once any of your images or your timeline is deleted, there is no option for recovery.

Should any use be found to be illegal, subject to complaint, a breach of ethics or cause any other infringement, we reserve the right to suspend or ban any User at any time.

9. Accessibility

We are constantly working to make ScotlandsPeople.gov.uk as accessible as possible to every User of the website. More detailed guidance can be found in our accessibility statement.

10. Linking to ScotlandsPeople.gov.uk

You may link to our home page and relevant content records, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our Website in any website that is not owned by you.

Our Websites must not be framed on any other site, nor may you create a link that represents ScotlandsPeople.gov.uk content as being part of your or any other website.

We reserve the right to withdraw linking permission and you agree to immediately comply with any request to delete a link.

11. Requests to remove/take down content

You can ask for content to be removed/taken down from ScotlandsPeople.gov.uk. We will only do this in certain cases, for example, if it breaches copyright laws, contains sensitive personal data or material that may be considered defamatory or obscene.

Write to: Scotland's People Customer Services, National Records of Scotland, 3 West Register Street, Edinburgh, EH1 3YT or contact us to ask for content to be removed. You will need to send us details of the content and explain why you think it should be removed. When a valid request is received, the content in question will be temporarily taken down from public view on the website pending the review process. Take down requests are assessed by the NRS Reclosure panel composed of staff with relevant experience and chaired by a senior manager. All assessments for take down/removal of content will be completed within 30 days of the request being received and we will let you know the outcome.

Any decision to remove/take down content is at our discretion. This does not affect your statutory rights to request for information under the Freedom of Information (Scotland) Act 2002 and the Data Protection Act 1998.

12. Virus protection

We make every effort to check and test ScotlandsPeople.gov.uk for viruses at every stage of production. We do not guarantee that our Website will be secure or free from bugs or viruses. You must make sure that the way you use ScotlandsPeople.gov.uk does not expose you to the risk of viruses, malicious computer code or other forms of interference which can damage your computer system.

You are responsible for configuring your information technology, computer programmes and platform in order to access our Websites. You should use your own virus protection software.

We are not responsible for any loss, disruption or damage to your data or computer system that might happen when you use ScotlandsPeople.gov.uk.

13. Our rights

We reserve the right to:

(i) modify or withdraw, temporarily or permanently, the Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website;
(ii) change these Terms and Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed. If you do not agree to any change to the Terms and Conditions then you must immediately stop using the Website; and/or
(iii) withdraw any products from the Website at any time and/or remove or edit any materials or content on this Website.

14. Assignation

You may not assign or otherwise transfer any of your rights under these Terms and Conditions.

15. Indemnity

Without prejudice to any rights or remedies available to us, you shall indemnify National Records of Scotland against all actions, suits, claims, demands, costs and expenses which we may suffer or incur as a result of or in connection with any damage or loss which may result directly or indirectly from a breach by you of your obligations under these conditions or any negligent or wrongful act or omission by you.

16. Limitation of liability

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Website or any content on them, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

(i) use of, or inability to use, our Website; or
(ii) use of or reliance on any content displayed on our Website.

This includes (but is not limited to) the loss of your:

  • income or revenue;
  • profits, sales, business, contracts, benefits or other payments;
  • anticipated savings;
  • tangible property or intangible property, including loss, corruption or damage to data or any computer system;
  • business opportunity, goodwill or reputation; or
  • any indirect or consequential or special loss or damage.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.

17. Circumstances beyond our control

We shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our control.

You acknowledge and agree the provision of the Website does not include provision of a computer or other necessary equipment to access the Website. To access them you will need an Internet connection and appropriate telecommunication links. We shall not be liable for any telecommunication links or other costs that you may incur in accessing and using the Website.

18. Delays in enforcing these terms and conditions

Any failure by us to enforce any right or remedy available to us under these terms and conditions shall not affect our decision to exercise or enforce that right or remedy at a later date, nor shall that failure by us to insist upon strict performance by you of any provision or provisions of these terms and conditions be taken to be a waiver of the provision or provisions.

In the event that any of these terms and conditions are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions will still apply.

19. Governing law

These terms and conditions are governed by and construed in accordance with Scots law and subject to jurisdiction of the courts of Scotland.

20. Entire agreement

These terms and conditions, including any terms, conditions and policies expressly referenced herein shall constitute the entire agreement between you and us, and shall supersede and cancel any prior or contemporaneous agreements, except as expressly provided otherwise by National Records of Scotland. Except in respect of liability that cannot be excluded under applicable law, you acknowledge that you have not relied on any representation, warranty, condition or undertaking apart from those (if any) expressly set out herein.

Scotland's People Purchasing Terms and Conditions for Credits, Certificates (Extracts), Images and Tickets

1. Agreement

These pages and any page it links to explains ScotlandsPeople.gov.uk terms and conditions upon which we will sell you Pay per view/Pay as you go Credits to purchase our digital images, or a voucher, or to purchase a Certificate (also known as an extract), or images from our image library or to sell you tickets for a Search Room seat at our Scotland's People Centre. You must agree to these Purchasing Terms and Conditions to make a purchase from ScotlandsPeople.gov.uk and by placing an order on the Website you agree to accept them. All orders are subject to acceptance by us.

If you do not agree with any of these Purchasing terms and conditions you must not purchase any credits, or vouchers, or certificates, or images from the Website or a ticket for a Search Room seat at our Scotland's People Centre. You should read and accept the full ScotlandsPeople.gov.uk Website Terms and Conditions of use before making a purchase.

2. Who we are

3. Accessing our Records through Free to Search indexes or Free to View and Pay to Save

You can only use Credits, including those purchased through a voucher, and Certificates, and Images from the library, for personal or professional family history research (as a self-employed genealogist), private study or education, or for historical or statistical research.

3.1    Free to Search indexes

We make some records on this Website available to Users free of charge. You can search through the indexes of our historical records free of charge.  

3.2 Free to View and Pay to Save

There is a charge (credits), to download, or to save, the digital image of an individual record within certain record sets. Often this is because the record sets are not suitable for index based searching. Instead these records sets are available for Users to browse directly and then purchase the images they want to save for future reference.

Digitising paper records is costly in order to create the digital images and normally involves additional cataloguing and electronic transcription work to ensure that the records are searchable on the Website. When we decide to digitise and/or index a collection of records, we either work with commercial, or academic, organisations, or we do the work ourselves and make digital copies available through ScotlandsPeople.gov.uk.

The prices we charge for viewing and downloading digital images and images from our image library are set out in our charges.

We reserve the right to offer any promotional credits at any time and at our absolute discretion.

4. Pay per view/Pay as you go Credits

Access to the digital images of certain record sets on this Website is based on a system of credits. Credits are available to purchase, are valid for a period of two years from time of purchase and will expire if you do not use them in that time. Credits purchased through a voucher are valid for 2 years following the date from which the voucher is redeemed. However, a purchase of additional credits before the expiry date activates a new session of two years for any unexpired credits held in your account at that time.

Credits purchased do not have any monetary value and cannot be refunded. The number of credits required to purchase an individual digital image or set of digital images will be clearly displayed within this Website.

5. Fair usage

We operate a fair usage threshold to limit the number of records you can view. You can view/save/download a maximum of 400 records each day (any 24 hour time period beginning at 12.00am and ending at 11.59pm GMT/BST).

We reserve the right to suspend or terminate your account forthwith where we reasonably suspect you are in breach of the fair usage threshold in these Purchasing Terms and Conditions.

6. How to make a purchase

To make a purchase you must first register on the Website. In order to register on ScotlandsPeople.gov.uk you will be providing us with some personal information which we shall process in accordance with our privacy policy.

When you purchase from our Website you will be guided through the process of placing an order by a series of simple instructions.

A purchase on ScotlandsPeople.gov.uk can be made by debit or credit card, or by using a PayPal account, and shall be processed as soon as payment has been authorised by your card issuer, or by PayPal, via our secure payment gateway provider. We accept Visa, Mastercard, Switch, Solo, Delta and JCB. We do not hold your credit card or debit card, or PayPal account, information, including your account number, anywhere on our database at any time and this information will not be passed on to any third parties by our secure payment gateway provider.

Credits cannot be used to purchase certificates or to pay for day search seats at the Scotland's People Centre or to pay for images from our image library.

We will send you an e-mail acknowledgement detailing the credits/certificate(s) or images you have ordered once the order has been accepted and to let you when your order has been dispatched. When you receive the confirmation of your order e-mail you will be granted access to the record(s) purchased.

Once the order has been accepted, where you have purchased a voucher from the Website we will send you an e-mail acknowledgement detailing the voucher credits you have ordered and a redemption code granting you access to your purchase.

7. Vouchers

Vouchers purchased through the Website must be redeemed by the User on the Website within 2 years of the purchase date. The credits purchased through the voucher are then valid for 2 years following the date from which the voucher is redeemed unless an additional purchase of credits is made by the User.

8. Price and Payment

Prices can be found in our charges. All prices are in pounds sterling and inclusive of the current rate of Value added Tax (VAT) applied in the UK.

Payment can be made by any of the methods specified in the payment section of the Website. Payment will be debited and cleared from your account at the time of order.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or for non delivery.

Payment transactions are made through our secure payment gateway provider. These payment transactions are always encrypted. Your payment card details, PayPal account details and personal information will not be shared with any other organisation.

9. Description of products

We will take all reasonable care to ensure that all descriptions, details and prices of products on our Website are correct at the time the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including product descriptions may not always reflect the position exactly at the moment you place an order.

Any description given is for information only. No warranty (expressed or implied) is given concerning the quality, condition or suitability for any purpose of any products purchased.

We have taken great care in presenting the products on ScotlandsPeople.gov.uk as accurately as possible. The images you see will depend on your monitor's display and colour capabilities. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise.

Where any product is priced inaccurately on the Website due to system or typographical errors, we reserve the right to correct any and all errors when they do occur and cancel your order and refund you.

We may change our prices or the number of credits charged to view an image from time to time.

10. Legibility of the electronic images

Where the electronic image purchased is found to be illegible you can report this when viewing the affected image and selecting the onscreen option 'Report an Issue' or alternatively you can contact us. We will find out if the quality of the image can be improved or if a transcript of the document is available.

We will endeavour to rescan the image in order to improve the quality of that image and make it available on the website. Where it is not possible to do this we will use reasonable endeavours to provide a transcription of the legible wording as it appears in the original document from which the image was taken, but this will only be for the specific named person of your search.

Where the search result links to an incorrect or missing image you can report this when viewing the affected image and selecting the onscreen option 'Report an Issue' or alternatively you can contact us.

We will endeavour to locate the correct image and update the link on the website. You will be refunded any credits used to view the incorrect or missing image.

11. Ticket for a Search Room Seat at the Scotland's People Centre

You can purchase tickets on the website for a Search Room Seat at the Scotland's People Centre located at General Register House, 2 Princes Street, Edinburgh, EH1 3YY by selecting the date, search room and seat reference number from the available tickets.

The ticket for the Search Room Seat at the Scotland's People Centre provides access to Scotland's People at one seat at a computer terminal, in one of the search rooms, on one specified day only.

Tickets for a Search Room Seat at the Scotland's People Centre are non-refundable and may not be copied, transferred or re-sold to other parties.

Tickets may be transferred to another suitable date where not less than 24 hours working days notice of the Search Room Seat date has been provided to contact us.

We reserve the right to change a Search Room and/or Seat number, or close a Search Room due to unforeseen circumstances, but will endeavour to contact you in advance of the Search Room Seat date should this be case. You will be responsible for re-booking a date, search room and seat reference number.

Where the ticketholder is to be accompanied by a carer, the carer will be admitted free of charge to provide assistance to the ticketholder whilst they occupy their purchased Search Room Seat.

12. Cancellations and refunds

For the avoidance of doubt you enter into a contract for a purchase from us once the confirmation of your order has been sent to the email address provided by you in 'Your account details' within 'My account'. Subject to your statutory rights, you will have no right to cancel your purchase once the contract has been concluded and the credits have been made available within your account or the product purchased.

Refunds may be available in special circumstances and will be made at the sole discretion of Scotland's People Team where the credits and products are unused. Any refunds that are authorised will be made using the same payment type as the credits or certificates, or images were purchased with.

13. Age of user

A purchase of credits or certificates, or images on ScotlandsPeople.gov.uk or tickets for a Search Room Seat at the Scotland's People Centre can only be made by adults of the age of 16 years or over using their own account details.

Children under 16 years of age must be accompanied by an adult to use a Search Room Seat at the Scotland's People Centre.

14. Our right to amend products and records

We reserve the right to withdraw or edit any products and records from the Website at any time.

15. Suspension or termination of your rights to credits

The records on ScotlandsPeople.gov.uk Website are either subject to Crown copyright, rights related to or affording protection similar to copyright, owned by National Records of Scotland or licensed to us and may only be used in accordance with this Agreement.

We reserve the right to suspend or terminate your credits forthwith where we reasonably suspect you are in breach of these Purchasing Terms and Conditions or the Website Terms and Conditions of Use.

16. Assignation

You may not assign or otherwise transfer any of your rights under these Terms and Conditions.

17. Indemnity

Without prejudice to any rights or remedies available to us, you shall indemnify National Records of Scotland against all actions, suits, claims, demands, costs and expenses which we may suffer or incur as a result of or in connection with any damage or loss which may result directly or indirectly from a breach by you of your obligations under these conditions or any negligent or wrongful act or omission by you.

18. Limitation of liability

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees, or from our fraud or fraudulent misrepresentation or any other liability that cannot be excluded or limited by applicable law.

We will not be liable to any user for any loss or damage, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

(i) use of, or inability to use, our Website; or
(ii) use of or reliance on any content displayed on our Website.

This includes (but is not limited to) the loss of your:

  • income or revenue;
  • profits, sales, business, contracts, benefits or other payments;
  • anticipated savings;
  • tangible property or intangible property, including loss, corruption or damage to data or any computer system;
  • business opportunity, goodwill or reputation; or
  • any indirect or consequential or special loss or damage.

Any liability we have for losses you suffer arising from the purchase of credits or certificates shall not exceed the purchase price of the relevant credits or certificates and is strictly limited to your losses that were reasonably foreseeable.

We shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our control.

19. Delays in enforcing these terms and conditions

Any failure by us to enforce any right available to us under these terms and conditions shall not affect our decision to exercise or enforce that right at a later date, nor shall the waiver by us of any breach by you of any provisions of these terms and conditions be taken to be a waiver of the provision or provisions itself.

In the event that any of these terms and conditions are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions will still apply.

20. Governing law

These terms and conditions are governed by and construed in accordance with Scots law and subject to jurisdiction of the courts of Scotland.

21. Entire agreement
