 Adam Ferguson CC20/7/8 [p.574] Inventory Dr A. Ferguson At St Andrews the Tenth Day of October Eighteen Hundred and Sixteen years In presence of Robert Low Esquire of Clatto Commissary of St Andrews, Compeared Mr David Wright Writer in St Andrews, as pro[curato]r for Hugh Cleghorn Esquire, Colonel John MacGill and Daniel Robertson all after designed, and gave in the Inventory Deed of Settlement and Appraisement under written desiring the same might be Recorded in the said Commissary Court Books in terms of the act of Parliament Which desire the said Commissary found reasonable and ordained the same to be done accordingly Whereof the tenor follows Inventory of the Personal Estate of Doctor Adam Ferguson late Professor of Moral Philosophy in the University of Edinburgh thereafter residing in St Andrews who died on the 23[r]d day of February 1816 with interest due on principal Sums at that date. In presence of Mr Stuart Grace Commissary Depute of the Commissariot of St Andrews.- Compeared Hugh Cleghorn Esquire of Stravithy Colonel John Macgill late of His Majestys Nineteenth Regiment of Foot and the Reverend Doctor David Robertson Professor of Hebrew in the University of St Andrews accepting Trust Disponees of the deceased Doctor Adam Ferguson late Professor of Moral Philosophy in the University of Edinburgh thereafter residing in St Andrews, Who being severally solemnly sworn and examined depones That the said Doctor Adam Ferguson died on the twenty third day of February last and the deponents have entered upon the possession and management of the deceaseds personal Estate in Virtue of and as Trustees nominated by him in a Trust Disposition and Settlement executed by him upon the Thirteenth day of October Eighteen Hundred [p.576] Hundred and Seven, and Codicils thereto, dated the twenty first July Eighteen hundred and eight, eighteenth January Eighteen hundred and ten, and first June Eighteen hundred and Eleven, registered in the Burgh Court Books of St Andrews as a probative Writ the Nineteenth day of March last, and which is now exhibited and signed by the Deponents and the said Commissary Depute of this date as relative hereto, and also as Executors dative decerned to him. That the Deponents do not know of any Settlement or Writing left by the deceased relative to the Disposal of his personal Estate or Effects or any part of them other than that now exhibited. That the said Inventory which is signed by the Deponents and the said Commissary Depute as relative hereto is a full and complete Inventory of the Personal Estate and Effects of the said deceased Doctor Adam Ferguson wheresoever situated and belonging or due to him beneficially at the time of his death in so far as the same has come to the knowledge of the Deponent; and that the value of the said Estate situated in Scotland is of the value of Three Thousand pounds and under the value of Four Thousand pounds Sterling, All which is truth as the Deponent shall answer to God. –(Signed) Hugh Cleghorn J[oh]n Macgill Daniel Robertson, Stuart Grace Comr Dept.- Last Will Testament or Disposition of Adam Ferguson L.L.D. I Adam Ferguson late Professor of Moral Philosophy in the College of Edinburgh now in old age retired to Hallyards in the parish of Manor and County of Peebles, being in health and in the exercise of my usual faculties do execute the following Deed of Provision in behalf of my surviving family at present consisting of three Sons and three Daughters, my Sons Adam Ferguson an Officer in the Kings Troops or aid de Camp & Military Secretary to the Commander in Chief in the Island of Jersey, James Ferguson of the Hon[oura]ble East India Companies Military Service in Bengall and John Ferguson Lieutenant on Board His Majesty’s armed Brig the Red Wing My [p.577] My three Daughters being Isabella Ferguson, Mary Ferguson and Margaret Ferguson at present living in family with me. Considering that my said three Sons are qualified to struggle with the world without such aid as I can give, Whilst my said three Daughters depend for comfort & support on such arrangement as I can devise in the event of my decease, on these considerations To Sir Adam Ferguson Baronet of Kilkerran, Sir William Narine of Dunsinnan Baronet one of the Senators of the College of Justice in Scotland, Sir John McPherson Baronet late Governor General of the Hon[oura]ble East India Companies Settlements abroad, John Fordyce of Ayton Esqr. William Adam of Blair Adam Esqr. John Clerk of Elden Esqr. And Robert Nutter Campbell of Spindlehope Esqr. Whom I am proud to call my surviving Friends & whose protection I fondly anticipate for my surviving family together with my worthy relations Joseph Burnett Esqr. late of the Hon[oura]ble East India Companies services Samuel Burnett Esqr. of Loyd’s Coffee House London and James Russell Esqr. of Edinburgh Surgeon & Clerical Lecturer in the Infirmary or to any three or more of them accepting of this Trust I now Give and Grant all my Effects of every kind whether moveable or heritable of any such I have in Trust for the following purposes namely 1st For the payment of all my just debts. 2ndly For the purchase or Rent of a house or dwelling for my for[e]said three Daughters such as their recourses may be adequate to & such as may enable them to receive any of their for[e]said Brothers my sons whom sickness or other circumstance may induce to take refuge with them and 3rdly to continue or place under proper securities whether public or private all the remainder of any Effects in joint property or disposal for life of my forsaid three Daughters or the survivors or survivor of them, and failing them in joint property or in equal shares as they may incline to my foresaid three Sons of the survivors or the survivor of them and this being the Disposition [p.578] Disposition of their Patrimonial concerns to commence at my decease, My three Daughters forsaid will be pleased to know my will in respect to the following particulars 1st That all my Pictures prints or other memorials of my Friends are to be reserved or retained except that Picture or Portrait of my much respected Friend General John Fletcher Campbell. This Picture with the note which I mean to inscribe on the Back of the Canvas is to be delivered to the Trustees or Guardians of his surviving Heirs to be placed in some apartment of The House of Saulton as the Family of Saltoun shall ordain ? that whatever I have given in my lifetime to any of my Children or Friends shall remain property with them as for instance the diamond Ring being inadviseable given to my said Daughters Isabella Ferguson, Whatever Trinkets remain My Daughters will dispose of among themselves or their Brothers as they may incline with the exception of my Gold repeating Watch, which I desire may be given to my son Adam Ferguson, Moreover my Daughters forsaid will be pleased to know That the correct Copy of my work on the principles of Moral and political science is during a period of fourteen years yet to come the property of the Booksellers Cadil & Leavies of London & may be delivered to them for republication on their payin[g] Two hundred pounds in terms of their agreement with me, or at the end of said period of fourteen years may be disposed of as my Heirs may think fit. Moreover my said Daughters will know that my servants hired from year to year will be entitled at my decease solely to their wages up to the ne[a]rest term ending at my decease But I would have it understood That the aged Mary Currie for her long & faithful services if she do not remain with my said Daughters for Life on such terms as the Parties may agree [p.579] agree on, shall at parting receive Ten pounds in lieu of arrears of wages and thereafter six pounds a year in half yearly payments during her life In Confirmation of which together with the other Articles herein contained I now execute this Deed in my own hand writing on stampt paper & subscribed by me on this & the former preceding page at Hallyards in the parish of Manor on the Thirteenth day of October in the year one thousand eight hundred & seven in presence of these Witnesses James Tait and William Tait both my servants. At Hallyards as above but on the twenty first day of July in the year one thousand eight hundred & Eight. I Adam Ferguson late Professor of Moral Philosophy in the College of Edinburgh now residing as above having on the two preceding pages of this paper bearing date the thirteenth day of October One thousand eight hundred & seven executed a Disposition of all my Effects of whatever kind to certain persons therein named in trust & for the Benefit of my three Daughters Isabella Mary and Margaret Fergusons now subjoin this Postscript or Codicil to compleat the List of my Trustees and to amend a grant made in the foresaid Disposition for which ends I now grant to Henry Lord Viscount Melville Author of many favours & acts of kindness to my family together with James Ferguson Esqr. of Monk Advocate who has kindly expressed his willingness to accept of this Trust in conjunction with those already named in the foresaid Disposition or to any three or more of them accepting of this Trust all my Effects of whatever kind for the Benefit of my foresaid three Daughters in terms of my foresaid Disposition or to the effect therein expressed, And that I now by this Codicil retract or annul the Destination of my Gold repeating Watch to my son Adam Ferguson and now ordain that the same be given to Robert Ferguson late of Bengall but now of Philadelphia in the State [of] Pensilvania & north America residuary Legatee of [p.580] of my late Brother Robert Ferguson in token of my esteem & sense of his kindness in many instances towards my family in evidence of which I now subscribe this Codicil in my own hand writing date of time & place as above in presence of these Witnesses James Tait & Michael Cranstoun both my servants. I Adam Ferguson within described now execute this my second Codicil merely to subjoin to the within list of my Trustees or Executors the following persons namely Robert Ferguson as within named with my much respected Friends Hugh Cleghorn of Stravithy Esqr. Lieutenant Colonel John McGill late of His Majesties Nineteenth Regiment of Foot and the Reverend David Robertson Professor of Hebrew in the University of St Andrews with like powers and for the same purposes as within expressed.
