Chalmers Esq[uire]. 88 6 8 £209 18 3 9Signed) James Chalmers W[illia]m Reid At Dundee the twenty first day of December Eighteen hundred and fifty three years in presence of William Reid Esquire Commissary Depute for the Commissariot of Forfarshire Compeared per- -sonally James Chalmers formerly resisding in Mon- -trose, now in Dundee, who being solemnly sworn and interrogated Depones That James Chalmers Bookseller Station- -er and Printer in Dundee, Deponents Father, died at Dundee upon the twenty sixth day of August Eighteen hundred and fifty three and the Deponent and Charles Dickson Chalmers residing in Dundee, also a Son of the deceased, and Charles Clark. Merchant in Dundee have entered upon the present And management of the deceaseds personal Estate as my Accepting Trustees and Executors nominated by him upon the Twenty sixth day of September Eghteen hundred and forty Two which is now exhibited and signed by the Deponent And the said Commissary Depute as relative hereto That That the Deponent doed not know of any Settlement or Writing relative to the disposal of the deceaseds personal Estate or Effects or any part of them other than the Will Or Testamentary Writing before specified and a separate Paper dated Twenty sixth May Eighteen hundred and Forty six titled “Scroll of Codicil or Appendage to My Will which separate paper is Autograph of The deceased and subscribed by him, and is also Now exhibited and signed by the Deponent and The said Commissary Depute as relative hereto; That The foregoing Inventory which is signed by the De- -ponent and the said Commissary Depute as relative hereto is a full and true Inventory of all the said deceased James Chalmers wheresoever situated, already recovered or known to the ex- -acting belonging or due to him beneficially at the time of his death; and that the value of the said Estate situated in Scotland is of the value of Three thousand pounds and under the value Of Four thousand Pounds Sterling; All which Is truth as the Deponent shall answer to God (Signed) James Chalmers W[illia]m Reid.- Appendix No.1 Good Debts William Arklay £14 8 7 James Alexander 1 3 5 Dr. Archibald .. 4 .. Chalmers My Brother Charles Chalmers Flaxspinner, Charles Clark Merchant and James R Ireland Mer- -chant all residing in Dundee, or the majority of them accepting or to each other person or persons as I may hereafter Appoint with power to them to Assume one or more Trustees, should those accepting deem it ne- -cessary to do so the major part in life to be a quorum declaring that the said Trustees shall not be personally liable for omissions or neglect of Office I very much regret that none of my Sons Are likely to follow my line of business, chiefly On account of the females of my family, I there- -fore instruct and empower my Executors to ap- -point one of themselves who shall be reasonably remunerated for his Trouble, And who shall find satisfactory, security, for his Intromissions with the funds and who shall along with qualified persons take an Inventory of my property and stock in trade as speedily as possible embracing embracing the various Departments separately, and put a value on such property and stock, as nearly as that can be ascertained according to the respective brances also to uplift the debts due to my Estate either by process or otherwise, as far as These can be accomplished, or to sell outstand- -ing debts and to ascertain from my Books the Bills Current and Claims against my Estate these Claims to be compared with accounts rendered and to be rendered, authenticated by oaths of verity if required deducting from such accounts, all munie printed Books or other articles Charged in them which have been sent to the shop on “Sale or Return” before Settlements are made I do farther impower the Executors to receive the sums for on my life, namely Three Hundred pounds In *[note in margin] the Norwich Union office and four hundred pounds in [main text] “The Scottish Equitable Office” along with any Bonuses due on The Policies respectively, the proceeds of these policies along With what may be recovered of Book debts and ready Money drawn from Sales, if the Shop is kept open, to Be applied In the first place towards the payment of Bills Current And debts on open Accounts, should the Proceeds from these sources, prove not ample for These engagements, the said Executors Are then dis- -pose of such portions of my property or stock as they may conceive to be most available fot the subject in view, either by Public Sales or Private Bargains Should it be deemed expedient to continue all or Certain portions of my business, to be carried on under proper management, for behoof of Mr Chalmers and my daughters the Survivors or Survivor of them this proportion is of course en- -tirely optionable with themselves, and if done it follows that it must be with their respective shares of the residue of my Estate, for if more is retained than their equal proportions, they will have to account to my Sons for the difference when that as adjusted, My property at present Consists of Houses and ground At Lochee, and a House in Thom’s Close High Street over these I have Five hundred ponds Borrowed. I hold thirty two shares of the Eastern Bank Stock. Five shares of the Dundee Marine Two shares of the Forfarshire Fire Insurance Company Nine Nine Sixty four of the Bug Gratitude. One Original share of the Tay Steam packet, one share Of the exchange Buildnings, and one share of The Tay Fermes, exclusice of my Stock in trade Consisting of Printing Materials, Piano Fortes Articles for manufacturing Books, Bookbinding Materials, Stock of printed and paper Books, Music and Miscellaneous Musical Instruments And stationery with shop Furniture, I hereby Empower my said Executors to dispose of these In the most judicious way for the Interest of All concerned, or of what remains more or Less (at the time of my death) which will be Found more particularly entered in my private Ledger The Balance or residue of my property I Hereby Instruct shall be divided in Equal shares Among my Wife and family Namely Mrs Barbara Chalmers or Dickson my Sons James Chalmers Robert Chalmers * [note in margin] Charles D Chalmers Patrick Chalmers my Daughters Margaret Chalmers [main text] & Anne Chalmers the Survivors or Survivor of them, but being Advances and under Certain obligation for Sons James Robert and Charles for Cash Credits & Otherwise it will be necessary that these be ad- -justed before or at the time of equalizing their proportions of the residue from my Estate, Should any of my Children Marry and die Before me, they he or her leaving a Child or Children.
