[Main text] At Edinburgh the twenty ninth day
of March in the year one thousand eight
hundred and fifty five In Presence of
the Lords of Council and Session Compeared
George Monro, Esquire, Advocate, Procurator
for Messieurs John and Henry Gordon
Gibson, Writer to the Signet, Ingivers of the
Last Will and Testament under written
desiring the same might be registered in
their Lordships’ Books conform to Act of
Parliament anent the Registration of
Probative Writs; which desire the said
Lords found reasonable and ordained the
same to be done accordingly whereof the
tenor follows: I James Gillespie Graham
of Orchill Esquire Architect in Edinburgh
with –
with a view to the settlement of my
affairs in the event of my death do
hereby nominate, constitute and appoint
my dearly beloved wife Mrs. Elizabeth
Marjory Campbell or Gillespie Graham
Miss Barbara Stewart Campbell her
Sister, Sir William Drummond Stewart
of Grandtully Baronet and George Drummond
Graeme of Inchbraikie, Esquire, and the
Acceptors and acceptor and survivors
and survivor of them to be my sole
Executors and administrators, with full
power to them to intrust with my
whole moveable Estate and Executry of
every description, to give up Inventories
thereof, to confirm the same, and
generally to do every thing in the
Premises competent to Executors;
declaring always that my said Executors
shall be accountable to the Residuary
Legatee herein after named for their
Intromissions in virtue hereof, but
under the following burdens & deductions
Viz[delice]t In the fisrt place, under the burden of
Payment of all my just and lawful debts
and-
and deathbed and funeral expenses, in-
-cluding among my Debts the obligations
undertaken by me in the Contract of
Marriage betwixt the said Mrs. Elizabeth
Marjory Campbell or Gillespie Graham
and me dated the twenty fourth day of
March Eighteen hundred and thirty; In
the Second place I direct my Executors
as soon as convenient after my death
to collect and hand over to my beloved
Daughter Mrs. Henrietta Gillespie Graham
or Oliphant Esq. Of Gask, the whole Plans,
Sketches and other professional papers
designs or pictures which may be in my
possession at the time of my death and
all my Architecture and professional
Books, and that as her own absolute
property; but as it is not my wish
that any of these plans, Sketches, Books
& others should pass into the hands of
any other professional person I request
that she will select such of them as
she thinks proper to keep and retain
for herself, and will present the rest to
my-
my faithful assistant and Clerk
Robert Hutton residing in Henderson Row,
Edinburgh; In the third place I direct
the whole family pictures in my
possession, including my full-length
Portrait by Mr. John Watson Gordon
to remain in the house of Orchill, But
I leave and bequeath to my beloved
Wife my portrait printed by the late
Sir Henry Raeburn; In the fourth place,
as there are various articles of Furniture
in the House of Orchill and in the house
at Portobello which belong to my
said wife, I direct my executors to
deliver these over to her as her own absolute
Property as well as to deliver over to
the said Miss Barbara Stewart Campbell
her Sister all similar articles belonging
to her; my said wife or sister-in-law
will be able to point out what the
articles are; In the last place, I leave
and bequeath to my said wife the
liferent of the whole residue of my means
and estate she being thus entitled to the
whole Interest & annual profits of my
whole-
whole property and the use of all
furniture bed and table linen, and
all other articles of which I may die
passessed but for her liferent use only; and
I hereby Constitute and Appoint my beloved
Daughter the said Mrs. Henrietta Gillespie
Graham of Oliphant to be my Residuary
Legate, and direct my executors to account
to her for the whole Residue of my means
and Estate after fulfilling the preceding
purposes, and I reserve full power to
myself at ant time in my life to Revoke
or alter these presents, as I shall think proper;
and I Consent to the Registration hereof in
The Books of Council and Session or any
other competent record therein to remain
for preservation and for that purpose
Constitute
my Procurators; In witness whereof these
Presents written by Charles Ogilvy, Clerk
to John Gibson, Junior, Writer to the Signet
are subscribed by me at Edinburgh the
Third day of March Eighteen hundred and
forty eight before these witnesses the said
John Gibson, Junior and William Galloway
also
also his Clerk (sig[ne]d) Ja[me]s Gillespie
Graham. J. Gibson, Jr. Witness, William
Galloway Witness-
I beg also to nominate the Master
of Strathallan as one of my Executors
(sig[ne]d) Ja[me]s Gillespie Graham Edin[bu]r[gh] 19th
April 1857 I also Nominate John
Gibson my Kind and faithful friend
to be one of my Executors, also Major
Charles Graeme, Grandson to the Brother
of the late William Graham of Orchill
(sig[ne]d) Ja[me]s Gillespie Graham. I hereby
Revoke & recall the request that my
Daughter should hand over any of
my plans, Sketches, Books or others to
Robert Hutton as it is not now my
wish that they should pass into
his hands, I now direct & appoint that
all these Articles shall be disposed of in
such way as my Daughter & my wife
shall think fit (signed) Ja[me]s Gillespie

I James Gillespie Graham within designed
do hereby Name and Appoint Mr. James
Blackadder Heriot Row, Edinburgh, to
be-
be one of my Executors & declare that
John Gibson, named as an Executor
by the previous Codicil is John Gibson

additional Codicil at Salem House,
Morningside this Twenty fifth
